Terms of use for AP+ Portals

By accessing or using this Portal provided by AP+ (the Portal), you agree to be bound by the following terms:

 

1. Confidentiality and permitted use

Information available through this Portal may include confidential and commercially sensitive material. You must:

  • Treat all information as confidential.
  • Use information solely for purposes connected with your organisation’s participation in one or more of the AP+ Schemes (the Permitted Purpose).
  • Not disclose any information to any person who is not expressly authorised by AP+ to receive it.

2. Use of third party authentication services

Access to the Portal is managed using Auth0, a third-party identity platform owned by Okta. By registering for and using this Portal, you acknowledge and agree that:

  • Your authentication credentials and login data will be processed by Auth0 on behalf of AP+.
  • Your data may be stored or transmitted via Auth0 systems, including systems located outside of Australia.
  • You are solely responsible for maintaining the confidentiality of your credentials and securing your access device.
  • AP+ is not liable for any unauthorised access, data breach, or service interruption arising from or related to the use of Auth0.

You should refer to Okta’s privacy policy for more information on how Okta handles personal information.

3. Testing environment

Where the Portal enables Members to test or validate their own software, integrations, or systems:

  • You acknowledge that the testing environment is not a production system and is provided without warranty as to accuracy, availability, performance, or completeness.
  • The Portal and associated testing tools may include or rely on open-source software components. AP+ takes reasonable steps to comply with applicable open-source licence terms.
  • While these components are selected with care, they are provided 'as is', and AP+ makes no warranties or guarantees regarding their compatibility, fitness for purpose, or security.
  • It is your responsibility to assess the suitability of the Portal and any tools made available through it for your intended use, including any impact from open-source components used in its development.

AP+ is not liable for any loss, corruption, or exposure of data, or for any adverse outcomes resulting from use of the testing environment. You must maintain appropriate safeguards and back-ups within your own systems.

4. Certification

The Portal includes functionality to support the certification of Participants and their systems, operations, and interfaces against applicable requirements, specifications and documentation prescribed by AP+ (“Certification Requirements”).

The applicable certification process may vary depending on the Scheme. Participants must refer to the relevant Scheme documentation for details of the applicable certification process, including any self-attestation procedures, testing requirements or implementation milestones.

By using the certification functionality in the Portal, you acknowledge and agree that:

  • You are responsible for ensuring the accuracy, completeness and currency of any information, documentation or evidence submitted as part of the certification process. 
  • Certification is limited to the scope and timeframe expressly stated in the relevant certification confirmation or record. 
  • Certification is not a warranty or endorsement by AP+ of your systems or operations, nor does it imply that your compliance will be monitored on an ongoing basis. 
  • You remain solely responsible for ensuring ongoing compliance with the Certification Requirements.

Access to the certification functionality may be revoked or suspended at any time. AP+ may modify the Certification Requirements, or the form or process of certification, in accordance with the relevant governance process.

5. No warranty and limitation of liability

All information and documents provided through the Portal are made available "as is" without warranty of any kind. AP+ does not guarantee that the portal will be error-free, continuously available, or free from viruses, malware, or other harmful components.

To the maximum extent permitted by law, AP+ disclaims all liability for:

  • Any direct, indirect, special, or consequential losses;
  • Any punitive damages; or
  • Any loss of data, business interruption, or damage to systems or devices, arising from:
  • Access to, use of, or inability to use the Portal;
  • Reliance on any information or document accessed via the Portal; or
  • Exposure to viruses, malware, or other harmful material through use of the Portal.

6. AI Capabilities

Certain features in the Member Portal may use artificial intelligence provided by a third-party service provider. AP+ does not create or control the output of these features. The results may contain errors, inaccuracies, or incomplete information and should not be relied upon as definitive.

7. Copyright and ownership

Copyright in each document is owned by the entity stated on the first page and in the footer of that document. No content may be reproduced, distributed, or adapted without the copyright owner’s prior written consent.

8. Suspension and termination

AP+ may suspend or terminate your access to the Portal without prior notice to you if you cease to be authorised or do not comply with these terms of use.

9. Changes to terms

AP+ may update these terms from time to time. Continued use of the Portal constitutes acceptance of the updated terms.
